1. Terms and conditions
These are the General Terms and Conditions (“GTaC”) of Woolunatics,
Registered with the Groningen Chamber of Commerce under nr. 01169255.
VAT (BTW) number: NL001954168B19.
Office address: H. Hasekampsingel 17, 9617EV, Harkstede, The Netherlands.
These GTaC shall apply to all purchases and sales agreements entered into by Woolunatics and its customers through the woolunatics.nl website (“the Website”). By checking the ‘Accept’ box you agree to their contents and their applicability to the agreement you enter with Woolunatics.
No account can be created, nor any purchase can be made, without agreeing with these terms and conditions.
2. Product Quality
2.1 DEFINITION OF STOCK YARN
Stock yarn is a left over from regular collections of yarn manufactures or knitwear factories. Therefore, yarn on cone can have loose ends or knots inside, what is not considered as a defect.
Stock yarn is not always wound on original cones. In such cases we rely on the information about yarn specification, provided by our supplier of Stock yarn.
2.2 COLOR DEVIATION
Shade of yarn in real life may differ from the shade that you see on the monitor, because the color display depends on the manufacturer of the monitor (matrix), its settings, calibration and color profiles used.
2.3 WEIGHT DEVIATION
The amount of moisture absorbed by the yarn depends on temperature, relative humidity of the air, atmospheric pressure, storage conditions at the buyer as well as on the type of fiber. These effects can lead to a change in the actual weight. The variation of the yarn weight can be up to 2%.
3.1 THE PURCHASING PROCESS
You can place an order on the Website by clicking on all desired items on the website, which will place them in your Shopping Cart. You may then inspect your Shopping Cart and make any changes necessary. Colors of the original product can be slightly different than the colors on the screen. Only one discount code or voucher per order is allowed. Once you find the Shopping Cart corresponding with your wishes, you may click on the ‘Checkout’ button, which will generate an electronic order form listing the desired items. Upon completion of the order form, including details of payment you will be transferred to a secure environment to finalize the financial transaction. This will complete your order.
3.2 THE SALE AND PURCHASE AGREEMENT
Upon processing your order, the Website will in principle send you an e-mail receipt. The sale and purchase agreement shall be completed from the moment said e-mail is sent. This said agreement shall therefore be deemed as agreed in The Netherlands.
3.3 REFUSING A TRANSACTION
The Webshop reserves the right however, to refuse to process a transaction for any reason and/or to refuse service to anyone at any time in its sole discretion.
4. Prices and information on the website
4.1 LISTED PRICES
The prices listed on the Website are in EURO and include VAT, but do not include shipping costs. The total price listed on the order list and on the electronic order form does include shipping costs. Prices are subject to change at any time. Products are sold on a delivery unpaid basis. The recipient may also have to pay import duty or a formal customs entry fee prior to/or on delivery. Additional taxes, fees or levies may apply according to local legislation and customers are required to check these details before placing an order for international delivery. Woolunatics has the right to change the pricing at any time.
4.2 PRICE CHANGES AFTER CONCLUDED SALE AND PURCHASE AGREEMENT
Changes in prices do not affect the sum payable in a concluded sale and purchase agreement as confirmed by Woolunatics by e-mail.
4.3 INFORMATION REGARDING PRICES, SPECIFICATIONS, ETC.
Although all information regarding prices, specifications, etc. is placed on the website with the utmost care, Woolunatics does not guarantee its accuracy.
4.4 NO OBLIGATION TO DELIVER IN CASE OF INCORRECT INFORMATION
Woolunatics shall not be bound to deliver any orders that were placed on the basis of incorrect information on the website.
4.5 INFORMATION ON EXTERNAL WEBSITES
Certain links on the website may give access to sites and sources of information that are exploited and maintained by third parties. Woolunatics does not control these sites and does not accept any liabilities regarding their contents.
Payment can be made by means of such creditcards or alternative methods as are indicated on the electronic order form. By making use of a certain creditcard(number) you confirm that the creditcard that is being used is yours. The amount payable will be debited from your account when your order is accepted by Woolunatics. All creditcard holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to Woolunatics, we shall postpone delivery and contact you. In that case Woolunatics shall not be liable for any delay or non-delivery. Creditcard details will be processed by means of an SSL (secured socket layer) connection. Woolunatics shall not be liable for any misuse of this data by third parties.
6. Shipping and delivery
6.1 SHIPPING OPTIONS
Upon checkout Woolunatics offers you the following shipping options:
- Ship to your registered address.
- Ship to a different address specified by you.
- Pick up from our address. You can indicate preferred pick up date and time and we’ll make an appointment. If the order hasn’t been picked up within 4 weeks we will cancel the order in line with articles 7.1 and 7.3.
6.2 DELIVERY PERIOD
Woolunatics shall do her utmost to deliver all purchases within the period indicated on the website. Woolunatics however is dependent on suppliers in this respect. As a result, all times indicated on the Website are indicative. Woolunatics shall not be liable in any way if delivery takes place at a later date.
6.3 DELIVERY OF YOUR PURCHASE
All goods bought at Woolunatics will be shipped within 7 working days. Selection of shipping company is at the discretion of Woolunatics. After your order has been shipped you will receive a trackingnumber by E-mail. If no email with tracking number has been received first check your spambox before contacting us. If the order hasn’t been shipped within 30 days, the costumer can cancel the order unless other shipping terms are agreed.
6.4 INSURANCE OF YOUR SHIPMENT
All items are insured by Woolunatics as per the General Conditions of the transporting company until such time that they have been delivered at your address. Any complaints regarding the state in which goods have been delivered must be made to Woolunatics no later than two working days upon receipt of the goods by e-mail at firstname.lastname@example.org.
In case your shipment is not delivered within 30 working days, Woolunatics will have the courier conduct an investigation of the status of your shipment upon your request. Only after the outcome of this investigation, Woolunatics may refund the value of your order. Such refund will be made if Woolunatics or the courier is to blame for not receiving your order.
7. Cancellations and returns
Cancelling an order is only possible before the order has left our warehouse.
As soon as the shipment has been collected or confirmed by the courier, the order is considered to have left the warehouse. Upon cancelation an administrative fee of 15% of the order amount will be withheld from the refund.
If you cancel an order after it has left our warehouse, additionally the shipping costs will be charged to you. Refunds will only be considered after the return shipment has been received by Woolunatics.
Cancellations of orders need to be done by email at email@example.com .
Please check the product carefully upon receipt and decide within 14 days whether you accept the product or send it back to Woolunatics.
Please be advised that the cost of return shipping is the customer’s responsibility except in the case of errors on our part.
After (partly) using the product, the product cannot be returned, nor entirely or partially refunded.
Products prepared at client’s specifications, prepared at custom quantities or sealed products with broken seal cannot be returned.
Downloaded digital products cannot be returned and will not be refunded.
Sale items and gift cards cannot be returned.
All goods bought at Woolunatics and eligible for return can be returned only after contacting us at firstname.lastname@example.org requesting a return.
After acceptance of your return you should then send your items back to our office at your expense. Items sent back to us without first requesting a return will not be accepted. This has to be done within 14 days upon delivery.
The goods are your responsibility until they reach our warehouse. Please use a trackable mailing method and save your receipt from the post office.
We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not.
All accurately returned products complying to the stipulations as laid down in articles 7.1 and 7.2 will be credited as a refund to store credit of your account.
Any import taxes or duties connected with the return shipment will be deducted from the refund.
7.4 RESPONSIBILITY FOR RETURN SHIPMENT
Woolunatics is not responsible for your return shipment to us. As sender of the shipment, you are responsible for the actual delivery of the return shipment to the return address of Woolunatics
8. Returns of sale items
SALE items cannot be returned.
The liability of Woolunatics towards the purchaser shall be limited to the amount of the purchase price. Woolunatics shall never be liable for any loss of profits or goodwill or any other consequential damages.
11. Language, applicable law and forum
All correspondence with Woolunatics must take place in English or Dutch unless specifically mutually agreed upon otherwise. Dutch law is applicable to all legal relations between Woolunatics and the Customer, even if the relations are in whole or in part to be executed abroad, or if the Customer resides abroad. The applicability of the Vienna Convention is expressly excluded. The laws of The Netherlands will apply to all transactions. Any dispute relating to a purchase and sale agreement to which these GTaC apply shall exclusively be brought before the District Court of Groningen.
12. Intellectual property
This website and all its subdomains are the intellectual property of Woolunatics. Nothing may be copied or used without permission of the owner.
Woolunatics reserves the right to change or delete any of the contents or elements on the website, without notification. Woolunatics can not be held liable for the consequences of changes or termination on / of its website.

14. Limited Liability
Woolunatics maximises its efforts to update and complement the Website as often as possible. Nevertheless, it might be possible that contents are incomplete or incorrect.
The materials and information on the Website are offered without any guarantee or liability for their accuracy.
These materials may be modified without any prior notification from Woolunatics.
Specifically with regard to prices and other information about products on the Website, we are not liable for any evident programming error or typos. On the basis of such errors, you cannot claim to have entered into an agreement with Woolunatics.
Woolunatics does their utmost to protect and secure the website, but we can’t guarantee the security of our website and can therefore not be held liable for any damage suffered directly or indirectly through the use of our website
Woolunatics does not take any responsibility and we are not liable for any damage caused by hyperlinks or reference to websites or services of third parties on the Website.
All intellectual property rights in these materials are vested in Woolunatics.
It is not permitted to copy, disseminate (further) or otherwise use these materials without prior authorisation in writing from Woolunatics, subject to any derogations in mandatory law (such as the quotation right), unless indicated otherwise for specific materials.
